The gov't doesn't pay towards railroads like they do regular roads. We re-invest in our own physical plant without taxpayer money.
And freight railroads are not public interest (unless you are a stockholder), nor are they considered infrastructure.

Aaah very untrue. I actually test track and the FRA requirement is rather frequently for a track to be tested (depends on weight going 1/2
Over it on average.) When we test there is most generally a crew right behind us fixing the defects. Derailment is more expensive than 1/3
