Nah, the bartender lending assistance doesn't tip the scales for me. I'm not a lawyer, but I'm fairly sure that assault is being threatening and causing fear. You're thinking battery, which is the physical hit. And I'm pretty sure that it is transitive to things you're touching to wearing. I can't knock a hat off your head, or punch your shirt while you're wearing it, and claim it isn't battery because I didn't touch YOU.
