Allow a merge, the person in control of the lane would likely only be 25-50% liable for inattention as, again, they have the right of way.
Maybe, every accident and claim is different. However, even with a dash cam showing an accident could have been avoided by stopping to 1/2
The person changing lanes has the greater responsibility to make sure it is safe to do so. The person not merging has the right of way.
