That is the best thing to do. Sometimes the police will not respond to a minor accident. Take photos of their license plate, drivers license

Depends on the state. Most states it would be 50/50, but in some states the vehicle merging left to right has the right of way.

Allow a merge, the person in control of the lane would likely only be 25-50% liable for inattention as, again, they have the right of way.

The person changing lanes has the greater responsibility to make sure it is safe to do so. The person not merging has the right of way.
