If it's a white person thinking that minorities don't know what's best for themselves or can't draw conclusions different from their own on minority-focused issues, it's definitely racist.
I get that, but the presupposition here is still "If minorities disagree with my conclusion, they're fundamentally too stupid to know what's best for them." If it's a white person in the USA with that attitude, it's inherently and expressly racist. Perhaps their experience isn't that (group) hates them or the relationship is far more complex than the extreme oversimplification being employed here.
The difference there is the person I replied to believes *minorities* that disagree with their POV are too stupid to think for themselves. The good old "They don't know what's best for them, but I do" mindset.
This is such a weird dismissal of anyone who disagrees with you as them being unable to think for themselves. Because why would anyone who hasn't been conned possibly have a different POV?

Considering I linked the DHS itself, I'd imagine there'd a good legal framework for that not being the case.
Further narrowing of the law occurs downstream. Regarding labor, the element of it being "forced" is required.
Different perspective/age has no bearing on the law itself.
It's not unnecessary or uncalled for when the crimes carry specific penalties and have specific elements.
Of course it doesn't make it right. The point is, don't call it something it isn't just for the sake of buzzwords/calling it something.
So is murder, but this isn't murder either.
And that behavior is detestable. Let's not engage in the same behavior.
trafficking until the law changes.
No. My argument is that human trafficking is human trafficking based on what the law is currently. This situation is not legally human
Definitely worth exploring at least. My Westlaw subscription lapsed long ago so I can't look up the precedent easily :(
The whole making them sign a waiver thing seems to be to prevent that... but having lied to them about the destination makes it interesting
It's tricky because it doesn't really "neatly" fit into kidnapping either. One element of kidnapping is that it's "against their will."
Definitely exactly what it feels like... Gross.
I really, strongly hope they're caught on something here though. Some bottom tier disgusting human shit.
That's not how the law works. They should be held accountable for being terrible, but why intentionally be wrong about it?
Weird, I'm mistaken. I had maybe an older copy of it up(?). My bad!
There is no subsection that they cited in the tweet. There is no 274(a)(1)(A)(ii) in the INA.
